Vista Capable plaintiffs subpoena PC titans

Dell, Toshiba, Amazon.com, Costco and Fry's Electronics are among the big PC makers and retailers that have been subpoenaed by the plaintiffs in the class-action lawsuit over Microsoft's Windows Vista Capable marketing program, according to the latest filings in the case. Other notable names on the list include Intel and former Windows chief Jim Allchin.

Here's a list of subpoenas issued by the plaintiffs.

As a reminder, this is the case that resulted in the release of that big batch of behind-the-scenes Microsoft e-mails a few weeks ago. The plaintiffs are looking for more documents along the same lines. But it's not clear if the process will go forward. Some companies that have received subpoenas have filed objections. Microsoft is also asking U.S. District Judge Marsha Pechman to put the case on hold while it asks an appeals court to review her decision certifying the suit as a class action.

In that decision, Pechman wrote that she wouldn't let the plaintiffs pursue class-action claims "that Microsoft's deceptive advertising induced consumers to purchase PCs that they would not have otherwise purchased." However, she wrote that they could pursue a "price inflation" theory, in which they could contend that consumers "paid more than they would have for their PCs had Microsoft's 'Windows Vista Capable' marketing campaign not created artificial demand for and/or increased prices of PCs only capable of running Vista Home Basic."

Underlying all of this is the plaintiffs' assertion that Windows Vista Home Basic isn't a real version of the operating system, because it lacks Windows Vista's signature features. Microsoft says it is a real version, and an improvement over Windows XP even without things like the Aero Glass interface available in premium editions.

The latest filings (PDF, 24 pages and PDF, 31 pages) give a sense for the types of documents the plaintiffs are seeking to support their case. For example, the plaintiffs ask Office Depot for information about the pricing of Windows and PCs, and for "documents pertaining to discussions or analysis as to whether Windows Vista Home Basic could or should be marketed as Vista."

The list above was filed by Microsoft's lawyers as part of their contention that the document requests shouldn't proceed pending a decision by the appeals court on whether to review the case.

Dang - that is just a shame - and Ballmer keeps on ingoring any questions about Vista being bad by pointing out how many copies he's sold. I think he'll pay any amount to avoid actually having to give a direct answer about anything negative involving Vista.

I don't hate MS and I'm not a Linux or Mac fanboy. I've runny every OS since DOS 4.x But Vista sucks and Ballmer just increases the negative publicity by forcing Vista down everyone's throat. Now maybe he'll feel our joy - Suck it Ballmer! Suck it long and suck it hard Ballmer

PictureI think taking a larger share of Facebook would be a good move. Facebook is preparing itself to be the platform of the web and this is exactly what MS needs. Also incorporating facebook services with outlook and hotmail could be extremely useful. Unfortunately, a complete buyout would put MS's name behind the service which could turn users away (as fickle as young people are) so, like the previous 250 million investment, it would need to be quiet."
